 Allgemeine Geschäfts- und Nutzungsbedingungen des LeClub Golf Treueprogramms 2020

EINLÖSEN VON FEES / Die gesammelte Fees Treuepunkte können zu folgenden Bedingungen eingelöst werden:

Präambel

Die LeClub Golf Karten werden von der Firma LeClub Golf SARL ausgestellt. Dabei handelt es sich um eine Gesellschaft mit beschränkter Haftung,   die im Handels- und Firmenregister von Nanterre unter der Nummer 809 416 076  eingetragen ist und über ein Kapital in Höhe von 10000 Euro verfügt.   Die Firmenzentrale befindet sich an folgender Adresse: 7/9 rue Nationale, 92100 Boulogne Billancourt. Mit dem Erwerb einer LeClub Golf Karte akzeptiert der Kunde die vorliegenden Allgemeinen Geschäftsbedingungen vorbehaltlos. LeClub Golf behält sich das Recht vor, die vorliegenden Allgemeinen Geschäftsbedingungen jederzeit zu ändern.

1. VORTEILE DER LECLUB GOLF KARTEN

Alle Golfplätze, die bei LeClub Golf Mitglied sind, verpflichten sich, Greenfees zu zwischen 20 bis 50 % ermäßigten Preisen anzubieten und den

Karteninhabern zu ermöglichen, FEES Treuepunkte zu sammeln und zu verwenden.

a) Ermäßigungen für Karteninhaber

GOLD PROGRAMM

• Bis zu 50 % auf die Greenfee-Preise der LeClub Golf Partnergolfplätze. Die Preisbedingungen im Ausland sind unter www.leclubgolf.com einzusehen. Die Ermäßigung ist nicht übertragbar und gilt nur für den Karteninhaber.

• mindestens 10 % auf Golfkurse.

• 5 % auf einen Aufenthalt bei unserem Reiseveranstalter-Partner Tee Off Travel.

• mindestens 10 % (Rabatt auf den günstigsten verfügbaren Katalog- oder Internet-Preis der Partnerhotels) oder in Form von

• Vorteilen (Upgrade, kostenloses Frühstück, Greenfee gratis …) in den LeClub Golf Partnerhotels.

CLASSIC PROGRAMM

• 20 % bis 35 % auf den Greenfee-Preis für 18-Loch der Le Club Golf Partnergolfplätze im laufenden Jahr. Die Preisbedingungen im Ausland sind unter www.leclub-golf.com einzusehen. Die Ermäßigung ist nicht übertragbar und gilt nur für den Karteninhaber.

• mindestens 10 % auf Golfkurse.

• 3 % auf einen Aufenthalt bei unserem Reiseveranstalter-Partner Tee Off Travel.

• mindestens 5 % (Rabatt auf den günstigsten verfügbaren Katalog- oder Internet-Preis der Partnerhotels) oder in Form von

• Vorteilen (Upgrade, kostenloses Frühstück, Greenfee gratis …) in den LeClub Golf Partnerhotels.

Bedingungen für die Gewährung der Ermäßigungen

• Die Greenfee-Ermäßigungen mit den Karten „Classic“ und „Gold“ werden ausgehend vom angegebenen Verkaufspreis berechnet und können nicht mit anderen Rabattpreisen oder Sonderangeboten kombiniert werden.

• Die Ermäßigungen werden ausschließlich für Einzelpartien gewährt, nicht für Gruppenpreise.

• Die Ermäßigung gilt ausschließlich für die 18-Loch-Bahn eines Golfplatzes. Auf Golfplätzen, die nur über eine 9-Loch-Bahn verfügen, gilt sie für die 9-Loch-Bahn.

• Wochentagsmitglieder können den ermäßigten Preis nur unter der Woche in Anspruch nehmen, also weder an Wochenenden noch an Brückentagen noch an Feiertagen.

• Die Buchung von Golfpartien ist stets nur im Rahmen der Verfügbarkeiten auf dem jeweiligen Golfplatz möglich.

Um im Ausland (außerhalb Spaniens, Frankreichs und Belgiens) zu spielen und von den LeClub Golf-Vorteilen (Classic und Gold) zu profitieren, ist es zwingend erforderlich, Greenfees über den Concierge-Service (conciergerie@leclub-golf.com) zu buchen. Der Concierge-Service kostet 10 Euro pro Abschlagszeit für 1 bis 4 Spieler. Beispiel: 3 Abschlagzeiten auf 3 verschiedenen Golfplätzen für 3 Spieler kosten 30 Euro.

b) Classic und Gold Versicherung

Die Gold Karte beinhaltet eine „Spielunterbrechung“–Versicherung mit Rückerstattung des Abonnements (bis  3000  €).  Sie  ist  ausschließlich Inhabern eines Jahresabonnements vorbehalten (Das Abonnement auf einem der LeClub Golf Golfplätze muss mindestens 750 € betragen). Der Inhaber muss den Jahresbeitrag bezahlt haben. Die Classic Karte beinhaltet eine Spielunterbrechung-Versicherung mit Rückerstattung der Karte

+ gratis Greenfees bei Wiederaufnahme der Spielaktivität (höchstens 150 €). Im Schadensfall wenden Sie sich bitte innerhalb von 30 Tagen an unseren Versicherungsservice: leclubgolf@grassavoye.com.

c) FEES Treuepunkte

SAMMELN VON FEES

Kunden, die an den Programmen „Classic“ oder „Gold“ teilnehmen, können FEES Treuepunkte sammeln. Dabei gelten folgende Regeln:

• Der gewählte Golfplatz muss für jeden Euro, der für die entsprechenden Produkte und Serviceleistungen des Golfplatzes ausgegebenen wird,

Fees anrechnen (die Liste der Produkte und Serviceleistungen ist bei den jeweiligen Golfplätzen einzusehen). Es gilt das Prinzip 1 € = 1 Fee.

• Beim Online-Kauf von Greenfees erhält der Karteninhaber seine Treuepunkte (FEES) nach dem Prinzip 1 € = 1 Fee.

• Das gewählte Hotel muss beim Check-out für entsprechende Produkte und Serviceleistungen des Hotels Fees nach dem Prinzip 1 € = 1 Fee

anrechnen.

Hinweis: Die teilnehmenden Golfplätze und Hotels sind im Führer und unter www.leclub-golf.com verzeichnet.

Der Reiseveranstalter TEE OFF TRAVEL rechnet für jeden Aufenthalt Fees nach dem Prinzip 3 € = 1 Fee an. Die FEES verfallen fünf Monate nach dem Ablaufdatum der Karte, wenn diese nicht verlängert wird. In diesem Fall wird das Guthaben auf null gesetzt. Nicht auf allen LeClub Golf Partnergolfplätzen im Ausland können FEES gesammelt werden. Kann der Golfplatz keine FEES gutschreiben, senden Sie einfach eine E-Mail mit  dem entsprechenden Ausgabenbeleg an contact@leclub-golf.com

Ermäßigungsgutscheine im Wert von 5 €

• Für jeweils 100 FEES wird dem Kunden (über seinen Mitgliederbereich) auf seinem Konto ein (digitaler) Gutschein im Wert von 5 €

gutgeschrieben.

• Der 5 € Einkaufsgutschein kann ohne Mindesteinkauf eingelöst werden.

• Der Golfplatz muss die 5 € Rabatt auf alle Produkte und Serviceleistungen gewähren, mit denen Treuepunkte gesammelt werden können.

Verfall der Fees

• Die FEES verfallen fünf Monate nach dem Ablaufdatum der Karte, wenn diese nicht verlängert wird. In diesem Fall wird das Guthaben auf null. FEES können nicht verwendet werden, wenn die Karte abgelaufen ist.

Geschenkshop

Der Kunde hat die Möglichkeit, mit seinen FEES im Geschenkshop Greenfees, Aufenthalte (je nach Verfügbarkeit) oder Tee Off Travel Einkaufsgutscheine zu kaufen. Der Geschenkshop ist über den Mitgliederbereich zu erreichen.

Greenfees: Sobald ein Kunde Fees einlöst, um online einen Greenfee-Gutschein zu bestellen, kann der Golfplatz den Gutschein im Kundenprofil sehen. Die Bestellung des Kunden wird per E-Mail bestätigt. Der Kunde muss die Golfpartie buchen (Tag und Uhrzeit).

Aufenthalte: Sobald ein Kunde Fees einlöst, um online einen Aufenthaltsgutschein zu bestellen, kann das Hotel den Gutschein im Kundenprofil   sehen. Die Bestellung des Kunden wird per E-Mail bestätigt. Der Kunde muss seinen  Aufenthalt  buchen.  Der  Aufenthaltsgutschein  wird  dem Kunden und dem Hotel innerhalb von sieben Tagen auf dem Postweg zugestellt.

Wenn ein Golfplatz oder ein Hotel das LeClub Golf Netzwerk verlässt und Sie Ihren Gutschein nicht einlösen konnten, ist dieser Gutschein nicht      mehr gültig. Die Punkte werden Ihnen dann wieder gutgeschrieben, damit Sie sie für einen anderen Golfplatz bzw. ein anderes Hotel einlösen    können. Die Gutscheine sind ab Bestelldatum ein Jahr gültig.

TEE OFF TRAVEL Einkaufsgutscheine: Der Reiseveranstalter Tee Off Travel bietet im Geschenkshop Einkaufsgutscheine im Wert von 100 € an (1200 Fees = 1 Gutschein). Diese Einkaufsgutscheine können online reserviert werden und sind ein Jahr gültig. Hinweis: ein einziger Gutschein         pro Person und pro Aufenthalt.

Hinweis: Die FEES können nur eingelöst werden, solange die Karte gültig ist.

d) Cash back Vorteile

Zum LeClub Golf Treueprogramm gehört auch ein Cashback-System, auf das Sie über den Mitgliederbereich Zugriff haben. Cashback bedeutet,     dass den LeClub Golf Mitgliedern ein bestimmter Geldbetrag gutgeschrieben wird, wenn sie ihre Einkäufe in einem von über 1500 Online-Shops tätigen. Beispiel: Ein LeClub Golf Mitglied kauft in einem Shop, der 5 % Cashback (auf den Bruttobetrag und ausschließlich Lieferkosten) anbietet, Waren im Wert von 100 Euro ein. Dafür werden dem Mitglied 5 Euro auf seinem Bankkonto gutschrieben (ab 20 Euro Cashback) und FEES angerechnet.

2. PREIS DER LECLUB GOLF KARTEN CLASSIC PROGRAMM

• Verkaufspreis: 49 €*, Gültigkeit: 12 Monate ab Kaufdatum / Erhältlich bei allen LeClub Golf Golfplätzen oder online.

Die Classic-Karte wird als 12-monatiges Abonnement mit automatischer Verlängerung verkauft. Diese automatische Verlängerung kann jederzeit gestoppt werden, indem Sie eine Anfrage an contact@leclub-golf.com senden oder den Kundenservice unter 05 57 21 19 90 kontaktieren.

*Preisempfehlung. Das Programm kann auf den Golfplätzen und online auch im Rahmen von Sonderaktionen angeboten werden. Ferner kann es in Kombination mit einer Greenfee auch als Paket angeboten werden.

GOLD PROGRAMM

• Nur für Inhaber eines Abonnements im Wert von mindestens 750 € bei einem Golfplatz, der Mitglied von LeClub Golf ist. Dieses Programm ist

nicht separat, also nicht ohne Abonnement erhältlich.

• Die Golfplätze können die Gold Karte als Teil des Abonnements oder gegen Aufpreis anbieten.

3. ALLGEMEINE NUTZUNGSBEDINGUNGEN

• Der Spieler kann die Vorteile des „Classic“ bzw. „Gold“ Treueprogramms nur nutzen, solange seine Karte gültig ist.

• Die Informationen zur Karte und deren Gültigkeitsdauer sind im Mitgliederbereich der Website www.leclub-golf.com einzusehen.

• Der Kunde kann diese Informationen jederzeit prüfen. Im Falle eines Irrtums kann er den Golfplatz, bei dem er abonniert ist, oder LeClub Golf anrufen und diesen Irrtum korrigieren lassen.

• Alle besonderen Bedingungen sind dem LeClub Golf Führer des jeweiligen Jahres und/oder der Website www.leclub-golf.com zu entnehmen.

• Wenn ein Golfplatz das LeClub Golf Netzwerk verlässt, verlieren die Abonnenten des Golfplatzes, die in Besitz der Gold Karte sind, die entsprechenden Vorteile. Die Karte gilt dann am Tag der Kündigung als abgelaufen. Der Kunde hat dann die Möglichkeit, ein Abonnement bei einem anderen Golfplatz, der Mitglied von LeClub Golf ist, abzuschließen und somit erneut seine Vorteile als Gold Mitglied zu nutzen.

4. WIDERRUFSFRIST BEIM KAUF MIT DER CLASSIC KARTE

Laut Artikel L. 221-18 ff. des französischen Verbraucherschutzgesetzes beträgt die Widerrufsfrist 14 Arbeitstage ab dem Tag nach Erhalt des        letzten Produkts Ihrer Bestellung. Während dieses Zeitraums können Sie Ihr Widerrufsrecht ohne Angabe von Gründen und ohne Zahlung einer Vertragsstrafe ausüben. Die Rücksendekosten gehen zu Ihren Lasten.

Sie übernehmen die Haftung für die Rücksendung der Produkte. Werden die Produkte bei der Rücksendung beschädigt, verfällt das Widerrufsrecht (siehe unten).

5. REKLAMATIONEN, VORSCHLÄGE

Sollte ein Golfplatz oder eine andere Partnereinrichtung sich weigern, bestimmte Vorteile der Karte zu gewähren, kann die Firma LeClub Golf SARL dafür nicht haftbar gemacht werden. Reklamationen und Vorschläge senden Sie bitte per E-Mail an: contact@leclub-golf.com.

ONLINE SALE CONDITIONS

ARTICLE 1 – Scope of application

These General Terms and Conditions of Sale (« the GTC ») apply, without restriction or reservation, to :

  • all sales concluded by LeClub Golf (« the Seller ») with non-professional buyers wishing to purchase the products (the « Products ») offered for sale by the Seller on the « LeClub-golf.com » website;
  • any purchase of services (the « Services ») offered by the Seller to non-professional customers on the « LeClub-golf.com » website.

Purchasers of Products and/or Services are hereinafter referred to as « the Customer(s) ».

The Terms and Conditions of Sale specify in particular the conditions of order, payment, delivery and management of possible returns of Products and Services ordered by Customers via the Internet site « LeClub-golf.com » (the « Internet Site »).

The main characteristics of the Products and Services (in particular the descriptions, specifications, illustrations and indications of dimensions or capacity) are presented on the Website.

The Customer is required to read them before placing an order.

The choice and purchase of a Product and/or Service is the sole responsibility of the Customer.

The photographs and graphics presented on the Internet Site are not contractual and shall not engage the Vendor’s liability.

The Customer must refer to the description of each Product or Service in order to know its properties and essential characteristics.

Offers of Products and Services are understood to be within the limits of available stocks, as specified when the order is placed.

The GTC apply to the exclusion of all other conditions, in particular those applicable to sales in stores or through other distribution and marketing channels for the Products or Services.

The GCS are accessible at any time on the Website and will prevail, if necessary, over any other version or any other contradictory document.

The Customer declares having read the GCS and having accepted them by ticking the box provided for this purpose during the online purchase procedure.

As the GCS may be subject to subsequent modifications, the version applicable to the Customer’s purchase is the one in force on the Website on the date the order is placed.

The modifications of the GCS are opposable to the users of the Internet Site as from their setting on line and cannot apply to the transactions concluded previously. The validation of the order of Product(s) or Service(s) by the Customer implies acceptance without restriction or reservation of the GCS.

The Customer acknowledges having the required capacity to contract and acquire the Products and/or Services offered on the Website.

In the absence of proof to the contrary, the data recorded in the Seller’s computer system shall constitute proof of all transactions concluded with the Customer.

In accordance with the French Data Protection Act of January 6, 1978, the Customer has, at any time, a right of access, rectification, and opposition to all his personal data by writing, by mail and by proving his identity, to the company LeClub Golf 7/9 rue Nationale, 92100 Boulogne-Billancourt.

The Products and Services presented on the Website are offered for sale for the territories of the European Union, Dom Tom and overseas collectivities .

In the event of an order to another country, the Customer is the importer of the Product(s) and/or Services concerned, and the price will be automatically calculated net of tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. They shall be borne and are the sole responsibility of the Customer.

ARTICLE 2 – Orders

It is the Customer’s responsibility to select the Products and/or Services he/she wishes to order on the Website, according to the following procedures: adding them to the basket, checking the basket and validating the order by clicking on « Validate and pay », which will be deemed to be full and unreserved acceptance of the GCS.
The offers of Products and Services are valid as long as they are visible on the Website, within the limits of available stocks.
It is the Customer’s responsibility to check the accuracy of the order and to report any error immediately.
The sale of product(s) or Service(s) shall only be considered final after the Seller has sent the Customer confirmation of acceptance of the order by e-mail and after the Seller has collected the full price
Any order placed on the Website constitutes the formation of a contract concluded at a distance between the Customer and the Seller.
The Customer may follow the progress of his order on the Web Site under the heading « My Orders ».
The Seller does not sell Products and Services on the Website to professionals, but only to consumers for their personal needs; it therefore reserves the right to refuse orders for the same Product or Services in excessively large quantities
For Products or Services for which an estimate has been drawn up in advance, their sale will only be considered final after :
the Seller has drawn up a quotation and sent the Customer confirmation of acceptance of the order by e-mail; the quotations drawn up by the Seller are valid for a period of 30 days;
Validation of the quotation and any other terms and conditions of sale or supply of the product(s) and/or Service(s) concerned by the Customer, by e-mail.
Payment of a deposit according to the amount shown on the quote. This deposit may not under any circumstances be qualified as a deposit.
In the event of cancellation of an order which has been the subject of a quotation and the payment of a deposit, by the Customer after its acceptance by the Seller less than 30 days before the date scheduled for its completion, for any reason whatsoever, except for the exercise of the right of withdrawal or force majeure, the deposit paid at the time of the order, as defined in article 2 above of the GTC, shall be automatically acquired by the Seller and shall not give rise to any reimbursement.

ARTICLE 3 – Rates

The Classic or Gold rates are automatically adjusted downwards by 1 euro less than the best rate available online if the « current rate » is less than or equal to the rates usually applied with the Classic and Gold card.
The Products and Services offered are provided at the rates in force on the Website, at the time the order is registered by the Seller and, if applicable, according to the estimate drawn up beforehand. Prices are expressed in Euros and include VAT.
The prices take into account any discounts granted by the Seller on the Website.
These prices are firm and non-revisable during their period of validity, as indicated on the Website, the Seller reserving the right, outside this period of validity, to modify the prices at any time.
They do not include the costs of processing and management, or shipping, transport and delivery, which are invoiced in addition, under the conditions indicated on the Website and calculated prior to placing the order.
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
An invoice is drawn up by the Seller and sent to the Customer by email after validation and receipt of payment.

ARTICLE 4 – Terms of payment

4.1 Method of payment

The Classic card is sold as a 12-month subscription with automatic renewal. This automatic renewal can be stopped at any time by sending a request to contact@leclub-golf.com or by contacting customer service on 05 57 21 19 90

4.2 Method of payment

The price is payable cash, in full on the day the order is placed by the Customer, by means of secure payment, according to the following terms and conditions:

  • by credit cards: Visa, CB, and MasterCard

In case of payment by credit card, the request for debiting the card will be made immediately to the bank.

The order will be considered effective only after confirmation of the agreement of the bank payment centers.

The Seller shall not be required to deliver the Products or provide the Services ordered by the Customer until the order is considered effective under the terms set forth above.

In addition, the Seller reserves the right, in the event of non-compliance with the payment terms set forth above, to suspend or cancel the processing of current orders placed by the Customer.

No additional costs, in excess of the costs incurred by the Seller for the use of a means of payment may be charged to the Customer.

It is up to the Customer to save and print its payment certificate if it wishes to keep the details of the transaction.

4.3 Payment security

Payment data is exchanged in encrypted mode using the SSL (Secure Socket Layer) encryption protocol.

Transactions are secured by the Stripe system. The Customer is invited to refer to the general terms and conditions of use of this payment platform for more information on its mode of operation.

During the payment process, the Customer’s bank details are transmitted in unintelligible form to servers that are the only ones capable of deciphering them; authorizations and data are then verified with the Customer’s bank in order to avoid abuse and fraud.

This process is based on the HTTPS protocol (implementation of SSL « Extended validation » v3.

The most sensitive information is transmitted with additional asymmetric key encryption.

The rules for the use of bank cards impose on banks domiciled in France the obligation to cover the risk of fraudulent use of your card; reminder that the Customer must in any event notify any fraudulent transaction to his bank or card issuing institution.

Express payment

During the payment process, the Customer may have the possibility to save his payment card details in order to facilitate his future purchases on the Website.

This information would then be registered and secured with the LeClub Golf partners selected by the financial institution.

The Customer’s credit card details would then be kept securely by the said bank and could be used for future payments on the Website.

This Data will not then be used for commercial prospecting purposes.

They may be communicated, as necessary, for the above-mentioned purpose to the retailer and the subcontractor of the financial institution established in the European Union. The transfers of data made necessary would take place under conditions and under guarantees that ensure the protection of these data.

The Customer will have a right of access, rectification and deletion relating to these data which he may exercise by mail to LeClub Golf, at the address mentioned in Article 1 of the GTC, which will relay his request to the banking institutions concerned, responsible for the processing of banking data.

ARTICLE 5 – Transfer of ownership – Transfer of risks

The transfer of ownership of the Seller’s Products or Services to the Customer shall only take place after full payment of the price by the Customer, regardless of the date of delivery or supply.

Regardless of the date of this transfer of ownership, the transfer of the risks of loss and deterioration relating thereto shall only take place when the Customer takes physical possession of the Products or begins to be provided with the Service. The Products and Services ordered therefore travel at the Seller’s risk, unless otherwise specified in the GCS.

ARTICLE 6 – Withdrawal and cancellation or modification

The right of withdrawal (for the purchase of Classic Cards or special Classic Card offers) must be notified by the Customer by telephone to 05 57 21 19 90, by unambiguous statement expressing the wish to withdraw, following which the Customer will be sent by e-mail an acknowledgement of receipt of the request made and a withdrawal form.
If the right of withdrawal is exercised within the above-mentioned period, only the price of the Product(s) or Service(s) purchased and the associated delivery costs will be reimbursed; the cost of returning the Product(s) or Service(s) will be borne by the Customer, as will the responsibility for transporting the Product(s).The exchange (subject to availability) or refund will be made within a maximum of 14 days from the date of receipt by the Seller of the Products returned by the Customer under the conditions set out in this article.
As an exception to the above and in accordance with the legal provisions, the Customer may not exercise his right of withdrawal concerning :
the products and services (green-fee) referred to in Article L. 121-16-1 of the Consumer Code, namely in particular contracts relating to a tourist package, within the meaning of Article L. 211-2 of the Tourism Code,
the services referred to in 2° of Article L.121-20-4 of the Consumer Code, namely ‘accommodation, transport, catering and leisure services which must be provided on a specific date or at a specific time’.

Modification at the request of the Customer:
The Client may, with the agreement of the golf course, modify a Green-fee reservation up to 24 hours before the scheduled departure time by making a request directly to the golf course
The Client may not obtain a refund whether or not the players have taken advantage of the Green-fees reserved.

Cancellation at the initiative of the Golf Club :
In the event of cancellation of a booking by the Golf Club, the Client will be notified directly by the Golf Club. The Golf Club will then offer the Customer another slot or a refund if no other slot is suitable.

Refund procedure if the Golf Club cancels the booking:
The refund is made by LeClub Golf and is made by transfer to the bank account communicated by the Customer at the time of booking on stripe within 4 to 10 days.
Only the price of the green fee(s) purchased will be refunded, to the exclusion of any other compensation. No costs of any kind whatsoever will be refunded or compensated.

Modification by the Client before departure with the Golf Club:
If the Client wishes to modify his reservation before the date of the course selected at the time of reservation, he must contact the Golf Partner directly. The Golf Partner may, without obligation, offer a new tee time. Additional charges may apply, which must be paid by the Customer directly to the Golf Partner.

ARTICLE 7 – Responsability

It is expressly agreed that, given the nature of its intervention, the obligations borne by LeClub Golf are obligations of means.
Furthermore, LeClub Golf shall not be held liable in the event of unavailability of the www.leclub-golf.com website, temporary suspension of access to the customer’s member area or occasional malfunctions of LeClub Golf cards.
In general, LeClub Golf shall not be held liable for any damage that is not the direct result of a failure on its part to perform its obligations. In any case, any compensation for immaterial damages is definitely excluded.
All prices indicated on the website www.leclub-golf.com are given as an indication, and are likely to be modified during the year and without prior notice.

ARTICLE 8 – Data Protection

In application of the law 78-17 of 6 January 1978, it is recalled that the nominative data requested from the Customer is necessary for the processing of his order and the establishment of invoices, in particular.
This data may be communicated to any of the Vendor’s partners responsible for the execution, processing, management and payment of orders.
The Customer is also informed that this data may be used to inform the Customer of current or future promotional offers, or to send newsletters or special offers.
The Customer may at any time configure his/her choices concerning these emailings by going to the Website, in the section « My Space / My newsletter subscriptions ».
The processing of information communicated via the Website has been declared to the CNIL.
The Customer has, in accordance with national and European regulations in force, a permanent right of access, modification, rectification and opposition, with regard to information concerning him/her, which he/she may exercise by sending his/her request (indicating e-mail address, surname, first name, postal address) by – by e-mail to the address contact@leclub-golf.com

ARTICLE 9 – Intellectual Property

The content of the Website is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly forbidden and is likely to constitute an infringement of copyright.
In addition, the Seller retains all intellectual property rights to the photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the request of the Customer) with a view to supplying the Products or Services to the Customer. The Customer shall therefore refrain from reproducing or exploiting the said studies, drawings, models and prototypes, etc., without the Seller’s express prior written authorisation, which may be conditional on a financial consideration.

ARTICLE 10 – Applicable law – Language

The GTC and the transactions arising from them are governed by and subject to French law.
The GTC are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.
The GTC and the order summary sent to the Customer form a contractual whole and constitute the entire contractual relationship between the parties. In the event of contradiction between these documents, the GTC shall prevail.

ARTICLE 11 – Disputes

All disputes to which the purchase and sale operations concluded in application of the GCS could give rise, concerning their validity, interpretation, execution, termination, consequences and consequences and which could not be resolved amicably between the Seller and the Customer will be submitted to the competent courts under the conditions of common law.

The Customer is informed that it may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (C. consom. art. L 534-7) or with existing sector-based mediation bodies or to any alternative dispute resolution method (e.g. conciliation) in the event of a dispute.

ARTICLE 12 – Pre-contractual information – Acceptance by the Customer

The Customer acknowledges having been informed, prior to placing his/her order, in a legible and comprehensible manner, of the GTCs and of all the information and details referred to in articles L111-1 to L111-7, and in particular :

  • the essential characteristics of the Products and Services, taking into account the communication medium used and the Products and/or Services concerned
  • the price of the Products and Services and related costs (e.g. delivery);
  • in the absence of immediate execution of the contract, the date or period within which the Seller undertakes to deliver the Product or provide the Service;
  • information about the Seller’s identity, postal, telephone and electronic contact details, and activities, if not apparent from the context,
  • information relating to legal and contractual guarantees and their implementation modalities;
  • the functionalities of the digital content and, where appropriate, its interoperability;
  • the possibility of resorting to conventional mediation in the event of a dispute;
  • information on the right of withdrawal (existence, conditions, time limit, procedures for exercising this right and standard withdrawal form), the cost of returning the Products or Services, the cancellation procedures and other important contractual conditions.

  1. Accuracy and confidentiality of personal information
    The Member undertakes, at the time of joining and throughout the duration of his/her participation in the Programme, to provide accurate information.
    Any update of this information must be made as soon as possible either via LeClub Golf Customer Relations, who may request any supporting documents deemed necessary, or directly via the LeClub Golf member’s area available on the website www.leclub-golf.com
    The Member is solely responsible for the use of his or her Card and for the protection of the related data. Any use made prior to a stop payment is deemed to have been made by the Member, who assumes full responsibility for it. In order to make a stop payment, the Member must notify LeClub Golf Customer Relations in writing or by telephone (with written confirmation sent to LeClub Golf Customer Relations).
  2. Use of data
    In accordance with the French law n° 78-17 of January 6, 1978 relating to data processing, files and freedoms, the Member is informed that the personal data concerning him/her entered at the time of membership or modified subsequently by the Member on the LeClub-golf.com website (member’s area) will be processed.
    The information obtained from Members, in particular identification data, account data, including the Card number and associated information, and data relating to transactions that have enabled the incrementation of FEES (loyalty points),
    LeClub Golf, acting as data controller, implements the processing of personal data for the following purposes
  • i. commercial management of Members ;
  • ii. management of the Programme and of the Member’s account (e.g.: recording of FEES Points and Status, issue of vouchers, Services and Benefits, updating of the account) and information for the Member.
    Management with AXA Insurance for the execution of AXA contract number 0803461 in the context of the subscription to the game interruption insurance.
  • iv. sending promotional offers to the Member in advance, as well as information relating to private sales reserved for him/her;
  • v. compliance with legal obligations;
  • vi. combating fraud (e.g. identity checks or checks on compliance with the conditions of the Programme);
  • vii. statistical studies aimed in particular at improving LeClub Golf programmes
  • viii. conducting satisfaction surveys;
  • x. organisation of competitions for Members;
  • xi. canvassing of Members;
  • xii. complaint management;
    The Member agrees to receive, by email and by post, communications relating to the management of the Programme. In addition, the Member may, if he/she so wishes, request to receive communications by SMS. In addition, if the Member agrees, LeClub Golf may send him/her commercial information via paper or electronic means relating to offers from LeClub Golf, its golf courses or its partners. The Member’s choice to receive commercial prospecting by post or electronically from LeClub Golf, its golf courses or its partners is in all cases subject to his express prior agreement by means of a corresponding checkbox accessible during registration via his member area. If the Member no longer wishes to receive commercial information, he/she can unsubscribe at any time via the dedicated link located at the bottom of each newsletter sent or uncheck the box via his/her member’s area under the heading my information.
    In this context, the Member’s information may be transmitted to
  • to LeClub Golf’s subcontractors and service providers for the above-mentioned purposes;
  • to the Programme’s partners in the context of managing transactions and orders;
  • to LeClub Golf partners;
  • LeClub Golf partner golf courses.
    With the exception of the above-mentioned recipients of personal data, LeClub Golf undertakes not to communicate to third parties, in any form whatsoever, the personal information in its possession. However, in certain circumstances, and in particular in the context of legal or tax proceedings, LeClub Golf may be obliged to communicate to public authorities the personal data in its possession. LeClub Golf cannot be held liable in this respect.
    Information marked with an asterisk is mandatory. Membership cannot be taken into account if these compulsory details have not been filled in. The optional information allows the management of the client account and the sending of information relating to the Programme. If the Member fails to complete them, he/she will not be able to receive the said information and any services offered through these channels.
  1. Rights of the Member
    In accordance with the provisions of Articles 39 et seq. of the law of 6 January 1978 relating to information technology, files and freedoms, the Member is informed that he/she has the right to access and rectify his/her personal data. The Member also has the right to object, on legitimate grounds, to his or her data being processed or, without reason and at no cost, to it being used for canvassing purposes, in particular for commercial purposes.
    To exercise these rights, the Member may write to LeClub Golf Customer Relations, 5 rue Archimède, 33706 Mérignac, France or send an e-mail to contact@leclub-golf.com. This request must be accompanied by a copy of an identity document (passport, national identity card, residence permit, driving licence).
    The Member may also send instructions to LeClub Golf in order to define the conditions of use, conservation and communication of his/her personal data in the event of death. The directives given by the Member are limited to the data collected by LeClub Golf in the context of the management of the Fidélité programme.   2. Retention periods
    The data collected by LeClub Golf is kept for the last three (3) years of membership in the LeClub Golf Programme, and for three (3) years from the end of the loyalty programme membership. Access to archived data will be strictly reserved for the relevant departments of LeClub Golf.
